Living in a condominium is favoured by many people for the security, the convenience and different amenities a property can offer. But it’s not always easy, having rules to follow and of course, considerable monthly costs.
The housing regulations set 20 years ago were revised this year by the Commission of Economy, Innovation, Public Works and Housing. There was a clear need for more transparency regarding the condominium expenses and transfer of responsibility when selling. The Commission proposed a list of improvements to property law and the project was approved on November 19th, 2021.
According to the new rules,condominium property owners who want to sell their property must inform the Condominium Management of the new owner (name and tax number), by registered mail, up to 15 days prior to the transaction.
Otherwise, they remain responsible for the expenses inherent to the identification of the new owner and for the charges incurred with the late payment of the condominium expenses that fall due after the transaction.
They also need to obtain a Declaration of Condominium Expenses and Debt, which becomes a mandatory element to be attached to the property deed. The Condominium Management has 10 days to provide the document.

- Declaração de encargos de condomínio em vigor, de não divida e sobre as obras a realizar – Declaration of Condominium Expenses and Debt.
